English Language Tutoring Services

PREAMBLE

This GENERAL TERMS AND CONDITION provides to customers information prior to the conclusion of the English Language Tutoring Services Agreement by payment of invoiced amount, under Slovak Consumer Protection Act 108/2024 Coll and Civil Code Law 40/1964 Coll.

    1. DEFINITIONS

    1.1 TUTOR Mr. Damian James Eastwood IČO: 51798476, Pernek 354, 900 53 Pernek, Slovensko Email: damianjames@eastwoodenglish.comTelephone: +421 (0)910 620 651 Registered: Okresný úrad Malacky Číslo živnostenského registra 120-22520 is a person who, in connection with an English Language Tutoring Services Agreement an obligation arising from it or in a commercial practice, acts within the scope of his business activity or profession.

     

    1.2 TUTEE (consumer) is a natural person who, in connection with an English Language Tutoring Services Agreement, an obligation arising from it or a commercial practice, is not acting within the scope of his business activity or profession.

    1.3 Lesson Packages are usually MONTHLY prepaid bundles of English Lessons that the TUTEE pays for in advance.

    1.4 English Language Tutoring Services Agreement is Agreement established, for indefinite period of time. Agreement covers initial and all subsequent Lesson Packages purchased by the TUTEE.

    1.5 Working Hours: For purposes of English Language Tutoring Services Agreement "Normal Tutoring Week" (Normal Tutoring Week) shall mean Monday through Friday, between the hours of 07:00 and 17:00.

    1.6 Group shall consist of a number of TUTEES who mutually agree to participate in shared lessons together. 

    1.7 No-Show: A TUTEE shall be deemed a "No-Show" if the TUTEE fails to attend a scheduled lesson without providing the required twenty-four (24) hours advanced notice as specified in Section 7.3 hereof, or if the TUTEE is fifteen (15) minutes or later for a scheduled lesson without prior notification to the TUTOR as specified in Section 9.2.

    1.8 Course Abandonment Definition: Course abandonment occurs when a TUTEE leaves the course before completing a purchased Lesson Package without Termination by Notice.

      2. TUTORING SERVICES

      2.1 Main Features of the Services

      (a) Pre-Contract Consultation: A complimentary consultation (online or in-person) including Cambridge English placement assessment, needs analysis, service explanation, and pre-planning discussion (including platform selection) to ensure mutual understanding before contract conclusion; (b) Service Commencement: Upon contract conclusion, scheduling of the complete Lesson Package and commencement with the first billable lesson which shall start 15 days after contract conclusion at the latest. If the 15th day falls on a Saturday, Sunday or holiday, the first lesson will be postponed to the next working day. Where possible TUTOR shall schedule lessons according to TUTEE'S needs and according to TUTEE'S Lesson Package type. (c) Ongoing Lesson Delivery: One-to-one and/or small group supplementary tuition for English language learners, delivered according to the agreed lesson format, whether structured textbook-based lessons or conversational practice with grammar correction and vocabulary assistance; (d) Adaptive Teaching Approach: Adjustment of teaching methods and materials based on the TUTEE'S engagement, learning preferences, and progress as appropriate to the agreed service delivery method.

      2.3 Service Extension Process: Additional Lesson Packages may be purchased as Service Extensions by requesting additional lessons by TUTEE and paying the corresponding invoice, thus maintaining the continuous nature of the tutoring relationship under concluded English Language Tutoring Services Agreement. TUTOR can refuse to accept additional Lesson Packages due to lack of capacity.

      2.4 Modifications of English Language Tutoring Services Agreement. Minor adjustments to lesson scheduling, teaching methods, or administrative procedures may be implemented by agreement as part of ongoing service delivery.

        3. CONSUMER PROTECTION AND WITHDRAWAL RIGHTS

        3.1 Right of Withdrawal: Under Slovak Consumer Protection Act 108/2024 Coll, the TUTEE has the right to withdraw from English Language Tutoring Services Agreement within 14 days of contract conclusion without stating reasons and without penalty. In this case full paid amount shall be returned to the TUTEE without any delay (within 2 business days) at the TUTEE'S bank account.

        3.2 Waiver of Withdrawal Rights: Under Section 19(1)(a2) of Act 108/2024 Coll, the TUTEE may expressly consent to waive the right of withdrawal of English Language Tutoring Services AgreementSection 19(1)(a2) of Act 108/2024 Coll: "the provision of the service began before the expiry of the withdrawal period with the express consent of the consumer and the consumer declared that he was duly informed that by expressing consent he loses the right to withdraw from the contract after the service has been fully provided, if the consumer is obliged to pay the price under the contract". This decision depends strictly on the will of the TUTEE. 

        3.3 Withdrawal Procedure: If withdrawal rights have not been waived, the TUTEE may withdraw by completing the withdrawal form available on the TUTOR'S website at https://www.eastwoodenglish.com/withdrawal within 14 days of contract conclusion.

        The body of alternative dispute resolution according to the Law 391/2015 Coll. on alternative dispute resolution and on amendments to certain law is the Slovak Trade Inspection.         4. LESSON PACKAGE PRICING, CONCLUSION OF ENGLISH LANGUAGE LANGUAGE TUTORING AGREEMENT, PAYMENT AND TERMS

        4.1 Lesson Packages Structure: The current configuration and pricing of Lesson Packages are published and periodically updated on the TUTOR'S website: https://www.eastwoodenglish.com. When the TUTEE purchase their first Monthly Lesson Package, The parties enter into an English Language Tutoring Services Agreement and TUTEE commits to attend those lessons the TUTEE has purchased.

        4.2 Payment Terms: All Lesson Packages shall be invoiced after receipt of order by TUTOR and payment shall be made in full via bank transfer prior to package activation and commencement of lessons. Each invoice is payable immediately.

        Full immediate payment is necessary and it is justified for reasons of reservation or creation of time space for providing services - course of lessons. 

        4.3 When Course abandonment occurs the TUTOR has no obligation to provide refunds to the TUTEE.

        5. LATE OR NON-PAYMENT OF FEES

        5.1 Consequences of Non-Payment: In the event that payment has not been received and cleared in the TUTOR'S bank account by the scheduled commencement date of any lesson or course of lessons, the TUTOR reserves the right to cancel and reschedule such lessons or course of lessons until such time as full payment has been received and verified.

        5.2 No Obligation to Provide Services: The TUTOR shall have no obligation to provide tutoring services in the absence of full payment, and any delay in lessons resulting from late or non-payment shall not entitle the TUTEE to any compensation.

          6. SMALL GROUP LESSONS

          6.1 Group Commitment: TUTEES participating in Group lessons acknowledge that the reduced fee is contingent upon continuation of the Group for the duration of the purchased Lesson Package. Group participants are collectively responsible for maintaining Group cohesion and attendance.

          6.2 Group Membership Changes: If an individual TUTEE leaves the Group, or if the entire Group disbands, the departing TUTEE(S) shall provide 3 days written notice of termination of the English Language Tutoring Service Agreement as specified in Section 11. In all cases failure to provide the required notice shall constitute Course Abandonment as specified in Section 4.3. If a minimum of two (2) group members remain then individual TUTEE departure does not affect remaining Group members.

          7. LESSON SCHEDULING AND TRACKING

          7.1 Schedule Request: The TUTEE may propose a lesson schedule to the TUTOR within the Normal Tutoring Week prior to the commencement of tuition services – usually provided as part of Pre-Contract Consultation according to Section 2.1 a) - scheduling discussion.

          7.2 Schedule Confirmation and Reservation: Upon mutual agreement between the parties regarding lesson times, such agreed-upon time slots shall be reserved and maintained for the duration of the Lesson Package.

          7.3 Discrete Lesson Cancellation: All cancellations require at least twenty-four (24) hours’ notice in writing via email (damianjames@eastwoodenglish.com), SMS, or other agreed messaging services. Cancellations made with less than twenty-four (24) hours' notice will be treated as a No-Show as specified in Section 9.1. Where reasonable both parties shall agree to reschedule lessons cancelled with notice within the same week as the original.

          8. STUDENT BOOKS

          8.1 Course Materials: In the event that the Contracting Parties agree to utilize a specific course textbook or educational materials ("Student Book"), the TUTEE agrees to acquire a legal copy of such Student Book at the TUTEE'S sole expense. The cost of the Student Book in not included in the Tuition Fees and shall be borne exclusively by the TUTEE as an additional expense.

          8.2 Legal Compliance: The TUTEE warrants that any Student Book acquired shall be obtained through legitimate channels and that the TUTEE shall comply with all applicable copyright laws and licensing requirements in connection with the use of such materials.

            9. LESSON ATTENDANCE

            9.1 No-Show Consequences: In the event of a No-Show, the TUTEE shall forfeit the full Lesson Package Credit for the missed lesson, and the TUTOR shall have no obligation to reschedule or provide a replacement lesson. Repeated No-Shows may result in termination of the English Language Tutoring Service Agreement at the TUTOR'S discretion.

            9.2 Late Arrival Policy: Either party shall notify the other party of late arrival, by email, sms, or telephone, at the earliest opportunity. (a) If the TUTEE arrives late for any scheduled lesson, the TUTEE remains responsible for payment of the full lesson regardless of reduced lesson time. For individual lessons only, at the TUTOR'S discretion and availability, a lesson may be extended beyond the originally scheduled end-time to accommodate the late arrival, up to the original lesson duration. (b) If the TUTEE is fifteen (15) minutes or later for a scheduled lesson without prior notification to the TUTOR the lesson is considered a No-Show and the TUTOR has no obligation to perform, reschedule, or provide a replacement lesson.

            9.3 TUTOR Late Arrival: If the TUTOR arrives late for any scheduled lesson, the TUTOR shall, where reasonably possible, extend the lesson to deliver the full originally scheduled duration. If the TUTOR is fifteen (15) minutes or later for a scheduled lessons without prior notificationto the TUTEE, the TUTEE shall be entitled to a single replacement lesson to be provided at the TUTOR'S expense.

            9.4 TUTOR Non-Attendance: In the event that the TUTOR is unable to attend a scheduled lesson, the following provisions shall apply:

            (a) Planned Cancellation: If the TUTOR provides notice of at least twenty-four (24) hours, the lesson shall be rescheduled within the same week, where reasonably possible, and at a mutually agreed time.

            (b) Emergency Cancellation: If the TUTOR is unable to provide twenty-four (24) hours advance notice due to illness, family emergency, or other unforeseen circumstances beyond the TUTOR'S control, the TUTEE is entitled to a single replacement lesson provided at the TUTOR'S expense.

            10. ONLINE LEARNING (HARDWARE AND SOFTWARE)

            10.1 Platform Selection: Online lessons are delivered via video conferencing technology designated by the TUTOR. The TUTOR reserves the right to select or change the video conferencing platform used as deemed necessary for optimal service delivery, provided reasonable advance notice is given to TUTEE(S).

            10.2 TUTEE Equipment: The TUTEE is required to access lessons using a laptop, desktop computer, or tablet device capable of supporting multi-tasking operations. The device must have a minimum screen size of ten (10) inches (25.40 cm) and be equipped with reliable internet connectivity, functional camera, microphone, speakers and/or headphones. A touch screen and stylus are recommended for optimal learning experience. Mobile phones are not acceptable devices for accessing tutoring services.

            10.3 TUTEE Technical Preparation Requirements: The TUTEE bears sole responsibility for: (a) providing, configuring, and maintaining their chosen device; (b) ensuring stable internet connectivity with sufficient bandwidth for video conferencing; (c) familiarising themselves with the designated video conferencing platform prior to lesson commencement; (d) testing all technical equipment before each scheduled lesson; and (e) ensuring technical competency with the hardware and software to avoid disruption of other TUTEES or wastage of lesson time. The TUTEE acknowledges that failure to adequately prepare technically may result in disruption to the learning environment and agrees to take all reasonable measures to prevent such occurrences.

            10.4 Technical Disruption Protocol: In the event that a TUTEE experiences technical difficulties that materially disrupt lesson delivery, defined as any problem which requires the TUTOR to provide technical support rather than deliver English language instruction, the following protocol shall apply:

            (a) The TUTOR shall allocate a maximum of five (5) minutes to assist the TUTEE in resolving technical difficulties;

            (b) If the technical difficulties cannot be resolved within the allocated time period, the TUTOR may, at the TUTOR'S discretion: (i) in group lessons, request the TUTEE to leave the lesson to allow uninterrupted continuation of the lesson for other participants; or (ii) in individual lessons, terminate the lesson;

            (c) In either case described in subsection (b) above, the TUTEE shall not forfeit their Lesson, and the affected lesson shall be rescheduled at no additional cost to the TUTEE.

            10.5 Recurring Technical Support Services: In the event that a TUTEE experiences recurring technical difficulties that prevent effective participation in lessons, the parties shall where possible: (a) arrange by mutual agreement for alternative offline tutoring arrangements; or (b) terminate the English Language Tutoring Service Agreement by Termination by Notice as specified in Section 11.

            10.6 TUTOR Technical Difficulties: Should the TUTOR be unable to deliver a lesson due to technical problems on the TUTOR'S end, the affected lesson shall be cancelled and rescheduled at a mutually agreeable date and time.

            11. TERMINATIONS

            11.1 Termination by Notice: Either party may terminate English Language Tutoring Services Agreement by written notice by email, to the other party after elapse of period stated in the point 3.4. Termination period is three (3) working days from delivery of the written notice containing termination to the other party. The TUTOR'S email damianjames@eastwoodenglish.com must be used for termination notice. The receiving party shall acknowledge receipt of the termination notice via email, which shall serve as official acceptance of the termination. If the receiving party shall not acknowledge receipt of the termination notice via email, which shall serve as official acceptance of the termination, termination is valid the fourth day following the day when termination notice was sent. In the case of Termination by Notice unspent payments shall be returned to the TUTEE without any delay (within 2 working days after elapse of termination period) at the TUTEE'S bank account.

            12. CONTRACT EXECUTION

            12.1 English Language Tutoring Services Agreement is concluded in the moment of receiving of the first full payment at the TUTOR'S bank account. By execution of payment TUTEE confirms that TUTEE has read the General Terms and Conditions of the TUTOR and agrees with them and the Information on the Processing of Personal Data. English Language Tutoring Services Agreement is governed by General Terms and Conditions Slovak Consumer Protection Act 108/2024 Coll., Civil Code Act. 40/1964 Coll. and other related laws. 

            12.2 After using all lessons in TUTEE'S Lesson Package, TUTEE has no obligation to purchase another. 

            12.3 English Language Tutoring Services Agreement will be stored by TUTOR for 3 years counting from the last provision of service according to the English Language Tutoring Services Agreement and it is accessible for TUTEE by request.

            12.4 English Language Tutoring Services Agreement- the language offered for concluding the contract is Slovak or English in the case that TUTEE does not speak Slovak language.

            12.5 Non-transferability: English Language Tutoring Services Agreement and its associated rights are personal to the TUTEE and may not be assigned, sold, leased, or transferred in whole or part by either party.
